Draco also won't like the insult to his pride that revealing the torture implies. But without that information, they probably can't win the case.
I think Draco's planning has gone a step beyond Slytherin. He decided, in the end, to fight directly rather than trying to bargain and see what he could get for his money/sacrifices.
Kingsley could perhaps manage a bargain like the one you describe, but it would take some high-class political maneuvering that he may not be capable of.
Lucius and Narcissa in this story are going to remain deliberately opaque, at least for a while. Their goals are so different from Draco's that they really have trouble comprehending each other.
