Yep. And actually, the mechanics won't be clear until Draco eats or drinks something with milk in it.
Harry has no idea that Daphne is doing anything like this, so he'll have to have that revealed to him first.
Draco and Harry still have a chance to make the Ministry just not outright ban the potion, but they'll have to work very, very carefully.
Hermione just wants to see both Harry and Ginny recover. She knows Ginny is happy with Dean, and she isn't pushing her towards Harry.
