The one good thing about Ron and Hermione's kidnapping is the timing of it. They disappeared just before the maze came into being. So it's possible the Unspeakables were all too busy dealing with the consequences of that to hurt Ron and Hermione.
Draco will realize the truth. Can he convince Harry, though? That remains to be seen.
