Harry is trying, sensibly enough, to straighten out all the contradictions around him. It's one of those times when he thinks not understandings things will put him and those he loves in danger. He'd be much more lenient towards Draco if there was someone else, someone he could trust, around.
Harry is judging Draco for the fact that he stood around, watched pain happen, and then continued to participate in the investigation instead of leaving. (Hence his comment that Pearl's arguments wouldn't have convinced Draco if Draco wasn't looking to be convinced). But then again, there are still other things he doesn't know about.
If the DoM has become that maze, though, Draco did have something to do with it. Or, at least, he showed the Unspeakables how to do it.
