Draco can admire Hermione's spellcasting abilities, if not her attitude to life in general.
Diggory honestly didn't think there would be surveillance spells; his spies didn't report any. And he mostly expected Draco to crumple and give up once he got Harry put away.
I think Draco, at least, would never use such potions openly unless he had to. That lessens the chance of them being used against him.
