In this case, Draco unconsciously gave permission; Harry just didn't sense it because he was rather wrapped up in his own magic. And Harry healed the wound behind him, otherwise it might have been a problem.

Artist!Draco shows up a lot in this story. In the next one, Cool and Calculating!Draco is more common, as they figure out how to market the potion.
